Terms of Service

These Terms of Service (“Terms”) govern the use of the Planck Security platform (“Service”) provided by Global Innovator Fund, operating under the brand Planck Security (“Provider”).

1. Scope

These Terms apply to all business customers (“Customer”) accessing or using the Service.

By using the Service, the Customer agrees to these Terms.

2. Services

The Provider offers a cloud-based security and identity management platform, including monitoring, analysis, and administrative capabilities.

Specific features may vary depending on the subscribed service plan.

3. Customer Obligations

The Customer shall:

• Use the Service only for lawful business purposes
• Ensure that users are authorized and properly trained
• Maintain the confidentiality of access credentials
• Comply with applicable laws and regulations

4. Availability and Support

The Provider shall use commercially reasonable efforts to ensure availability of the Service.

Planned maintenance and unforeseen outages may occur.

Support services are provided according to the agreed service level.

5. Data Protection

Personal data processing is governed by the Data Processing Agreement (DPA), which forms an integral part of these Terms.

6. Intellectual Property

All intellectual property rights in the Service remain with the Provider or its licensors.

No rights are granted except as expressly stated in these Terms.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Provider shall not be liable for indirect or consequential damages
• Total liability is limited to the fees paid by the Customer in the twelve (12) months preceding the claim

8. Termination

Either party may terminate the agreement for material breach upon written notice.

Upon termination, access to the Service will be discontinued.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland.

The place of jurisdiction is Switzerland, unless mandatory law provides otherwise.
